      Types of Defective Drugs

We’ve handled thousands of dangerous drug cases in California involving:
      • Celebrex.
      • HRT.
      • Hydroxycut.
      • Avandia.
      • Meridia.
      • Mounjaro.
      • Ozempic.
      • Wegovy.

      Effects of defective drugs

Whether prescribed by your doctor or you obtained them from your local pharmacy, defective drugs continue to flood the marketplace. Despite approval from the U.S. Food and Drug Administration (FDA), many prescription and over-the-counter drugs can cause life-altering side effects or adverse reactions. Many of these adverse reactions, such as diabetes, cardiac arrest, birth defects, hypertension, memory loss, stroke, and in worse cases, an untimely death, aren’t detected until it’s too late.

Adverse drug effects send an estimated 1.3 million people to the emergency room and are responsible for 350,000 hospitalizations each year and will continue to grow with the rise of Americans taking medications. More than three-quarters of Americans take at least one prescription medication, and nearly 30 percent take five or more.

Types of Defective Drug Liability Claims

There are three types of drug-related liability claims: defectively manufactured pharmaceutical drugs, pharmaceutical drugs with dangerous side effects, and improperly marketed pharmaceutical drugs.

Defective manufacturing—In this instance, the harmful side effects resulted from the manufacturing process either due to less than ideal manufacturing conditions, incorrect labeling, or errors made during the shipping process. In other words, any mistake made between the manufacturing facility and where you purchase the drug is considered defective manufacturing.

Pharmaceutical drugs with dangerous side effects—In this type of claim, despite being manufactured correctly, the medication itself presents side effects that result in an injury when taken. For example, a patient who ingests a drug and experiences kidney failure or a heart attack as a result, can pursue this category of drug liability claims. If it can be proven that the pharmaceutical drug manufacturer knew of the harmful effects and intentionally concealed them, victims are entitled to compensation for their damages.

Improper marketing—If you’ve ever watched an advertisement for a pharmaceutical drug where a series of dangerous side effects quickly flashed at the bottom of the screen, you’ve witnessed deceptive marketing practices firsthand. Drug companies have a responsibility to the public to provide adequate warnings regarding the harmful side effects or proper use of a drug.
